Accomplishments & Accolades

One of the most effective ways to fight for liberty is through the written word, and many of our HAN members are making great headway in that fight. In law reviews, online journals, and the editorial page of the Wall Street Journal, activists from around the country have been incredibly prolific. Take a look at how HAN members are advancing freedom:

Theodore Cooperstein (DCLC 99)
"The War on Terrorism: Law Enforcement or National Security."
A Federalist Society White Paper
This paper, a collaboration between Cooperstein and four other prominent attorneys, addresses the constitutional questions at stake in the debate over characterizing terrorism as an act of war or a mere crime. The paper aims to provide a clear distinction between issues of law enforcement and issues of national security.

David DeSchryver (LSC 01)
"Public Serving Self Interest—and Rightly So"
The Doyle Report
DeSchryver is a regular contributor to the Doyle Report, a free weekly publication covering the crossroads of education reform and the technology revolution. DeSchryver writes about reform efforts from a federalist point of view. In this particular piece, he touts the success of a Houston-based education reform program, in the context of individual rights and the public spirit.

Susanna Dokupil (LSC 98)
"It’s Not Like Yelling Fire in a Crowded Theater"
The American Enterprise Online

This online publication of the American Enterprise Institute focuses on higher education, science and the law. Dokupil is a regular contributor, writing about legal issues as they relate to freedom and restricted government.

Todd Hagins (LSC 00)
"Solving the Puzzle of Time Limits for Removal to Federal Court"
Defense Counsel Journal
This piece focuses on the reasons and ways to expand public access to the federal courts.

William E. Lee (SSC 96)
"The Unwilling Listener"
U.C. Davis Law Review
In this article Lee critiques the Supreme Court’s decision in the Hill v. Colorado protest case. Lee advocates more emphasis on privacy and shows that the Court’s treatment of privacy in this case is not in keeping with other First Amendment cases.

"Security Review and the First Amendment"
Harvard Journal of Law and Public Policy
In this piece, Lee examines the relationship between the press and the military during the early stages of "Operation Enduring Freedom," especially the military’s review of battlefield news coverage before publication in the context of the First Amendment. This article is part of a symposium entitled "Law and the War on Terrorism."

Ilya Somin (LSC 98)
"Closing the Pandora’s Box of Federalism: The Case for Judicial Restriction of Federal Grants to State Governments"
Georgetown Law Journal
This article argues that federal grants to state governments undermine federalism in several ways, but primarily because they undermine interstate competition. They also are unconstitutional because direct grants to state governments fall outside Congress’ Spending Clause Powers.
